FAQ

QuestionsWe Get Asked Most

How long does trademark registration take?

Filing takes 1–2 days and you can use ™ straight away. If there's no objection or opposition, registration typically completes in 12 to 24 months. The registration then lasts 10 years and can be renewed indefinitely.

What is the government fee for a trademark?

₹4,500 per class for individuals, DPIIT-recognised startups and small enterprises registered under Udyam, and ₹9,000 per class for others, for e-filing.

Should I file a provisional patent application first?

If your invention is still being developed, yes. A provisional application secures your priority date for ₹1,600 in government fees (for startups, MSMEs and individuals), and gives you 12 months to file the complete specification.

What's the difference between trademark, copyright and design?

A trademark protects your brand name and logo. Copyright protects creative work such as software, artwork and content. Design registration protects the visual shape or pattern of a product. Many businesses need more than one.

Someone filed a mark similar to mine. What can I do?

If it has been advertised in the Trade Marks Journal, you can oppose it within four months of the advertisement. If it's already registered, a rectification petition may be possible. Talk to us quickly; the opposition deadline can't be extended.
