How patent fees work in India

Official fees are set in the First Schedule to the Patents Rules, 2003. There are two fee columns: a lower one for natural persons, startups, small entities and educational institutions, and a higher one, five times as much, for everyone else. You claim the lower rate by filing Form 28 with proof of status.

The filing fee covers a specification of up to 30 pages with up to 10 claims. Each additional page and claim is charged separately, so a focused specification is cheaper. Filing a provisional specification first doesn't add a second filing fee.

Renewal fees are due every year from the third year after filing. If the patent is granted later, fees for the years already passed are paid together after grant. Paying online for at least four years in advance reduces the fee by 10%.

What is the patent filing fee in India?

₹1,600 for individuals, startups, small entities and educational institutions, and ₹8,000 for other applicants, for online filing of up to 30 pages and 10 claims.

How much is the request for examination fee?

Form 18 costs ₹4,000 for individuals, startups, small entities and educational institutions, and ₹20,000 for others. Expedited examination on Form 18A costs ₹8,000 and ₹60,000.

What do extra pages and claims cost?

Each page over 30 costs ₹160 (or ₹800 for others), and each claim over 10 costs ₹320 (or ₹1,600).

Does filing a provisional application cost extra?

No. The Form 1 fee is paid once, with the provisional. The complete specification filed later has no base fee; you pay only for pages over 30 and claims over 10.

Who pays the lower patent fees?

Natural persons, DPIIT-recognised startups, small entities (MSMEs) and educational institutions. If even one joint applicant falls outside these categories, the higher fee applies to the whole application.

Are these fees final?

They are the official e-filing fees in the First Schedule to the Patents Rules, 2003, as checked in October 2026. Fees can be revised by notification, so confirm the current schedule on ipindia.gov.in before paying.
