Provisional vs complete patent specification: which should you file first?

Indian patent law lets you start in one of two ways: with a provisional specification or a complete specification. Both are filed on Form 2 with the application on Form 1. Choosing well can protect your invention earlier and save money; choosing badly can leave gaps that can't be fixed later.

What is a provisional specification?

A provisional specification describes the invention and its working, but doesn't need formal claims. Its job is to give you a priority date: the date from which your invention is judged against everything else in the world. Anyone who files the same invention after you is behind you in line.

A provisional application is never examined and never becomes a patent on its own. Within 12 months you must file a complete specification, or the application is treated as abandoned under Section 9(1) of the Patents Act and the priority date is lost.

What is a complete specification?

A complete specification fully describes the invention, sets out the best method of performing it, and ends with claims that define exactly what the patent protects. It includes an abstract and drawings where relevant, and is filed with a declaration of inventorship (Form 5). It is the document that gets published, examined and, eventually, granted.

When to file a provisional first

  • The invention is still being developed. You can keep improving it for up to 12 months while holding your date.
  • You need to disclose it soon: to investors, customers, a conference, a journal or a thesis committee. File the provisional before you share.
  • You're unsure of its commercial value. The provisional buys a year to test the market before you invest in full drafting and foreign filings.
  • You're in a crowded field. Getting an early date matters when competitors are working on the same problem.

When to file the complete specification straight away

  • The invention is finished and tested, so there is nothing to add.
  • You want examination, and possibly grant, as early as possible, for example to license the patent or deter a competitor.
  • You plan to request expedited examination as a startup or small entity.

The biggest risk with provisionals: thin descriptions

A provisional only protects what it actually discloses. If the complete specification later claims features that weren't described in the provisional, those claims get the later date of the complete specification, not the provisional's date. If someone else disclosed the same feature in between, you may lose it.

A one-page provisional is a false economy. Describe the invention, its variations and how it works in as much detail as you can, including drawings and examples.

Combining several provisionals

If you file more than one provisional for related ("cognate") inventions, you can combine them into a single complete specification, filed within 12 months of the earliest provisional (Section 9(2)). This is common in research labs, where an invention evolves through several stages.

Provisionals and foreign filing

Your Indian provisional's date can also be claimed as the priority date abroad. You must file in other countries, or file an international PCT application, within 12 months of the Indian filing date. In practice, the complete specification and foreign filings are often prepared together near the end of the 12 months.
