Form 27 is the statement of working that every patentee in India must file. Since the Patents (Amendment) Rules, 2024 it is due once for every period of three financial years, starting from the financial year after grant, within six months of the end of that period. Form 27 tells the Patent Office whether, and roughly how much, a patented invention is being worked in India. Not filing it, or filing false information, can attract penalties under the Patents Act, and it is evidence the government can rely on for compulsory licensing.

How often is Form 27 filed now?
Once for every period of three financial years, starting from the financial year after the patent is granted, within six months of the end of that period. It was annual before the 2024 amendment.
Can the Form 27 deadline be extended?
Yes, by up to three months on request in Form 4.
What if my patent is not being worked in India?
You still file Form 27 and state that, with the reasons. Non-working is relevant to compulsory licensing, so explain the reasons carefully.
