EV, battery and clean-tech patents in India

Battery packs, cell chemistry, charging systems, motors and solar components are all patentable. Know how the chemistry and software rules apply before you file.

Quick answer

Electric-vehicle, battery and clean-tech inventions can be patented in India: battery cells and packs, thermal management, charging systems, motors and controllers, solar and energy-storage hardware, and the processes for making them. Electrolyte and electrode compositions must show more than an additive effect under Section 3(e), new forms of known materials need improved properties under Section 3(d), and battery-management software must produce a technical effect under Section 3(k).

Usually patentable

  • Battery cell and pack designs, thermal management and safety systems
  • Electrode, electrolyte and material compositions with a synergistic or unexpected effect
  • Charging hardware, swapping mechanisms and power electronics
  • Battery-management and motor-control software with a technical effect
  • Solar, wind, hydrogen and energy-storage components and manufacturing processes

Usually not patentable

  • A known material in a new form with no improved property (Section 3(d))
  • A mixture of known materials with only additive properties (Section 3(e))
  • A business model: subscription charging, battery leasing, carbon-credit trading (Section 3(k))
  • Assembling known components that each work independently (Section 3(f))

Chemistry: build the data before you file

For compositions, an examiner will ask what is unexpected about combining these materials. Comparative test data showing, for example, better cycle life, capacity retention or thermal stability than the individual components is what gets a composition over Section 3(e). For a new form of a known material, show the improved property for Section 3(d).

Software: claim the battery, not the maths

A state-of-charge estimation formula, on its own, is a mathematical method. Claim it as a method of controlling charging that uses the estimate to prevent over-charging and extend cell life, with the sensor inputs and control outputs described. See software patents.

A crowded field: search first

EV and battery technology is heavily patented by global companies, and many of their patents are filed in India too. A patent search before you file shows where the white space is, and a freedom-to-operate check before launch shows whether your product infringes someone else's patent. These are different questions.

File in India first, then abroad

If the invention was made in India by Indian residents, Section 39 requires you to file in India first (or get a foreign filing licence) before applying abroad. Then use the 12-month priority period to file a PCT or direct foreign applications in your export markets.

Frequently asked questions

Can I patent a battery pack design?

Yes, if it is new and inventive, for example a new cooling arrangement or a structure that stops thermal runaway spreading between cells. Assembling known cells and parts in a conventional way won't qualify.

Can battery management software be patented in India?

Yes, when it controls the battery or charging to produce a technical effect such as safer charging or longer cell life. A pure estimation formula is excluded under Section 3(k).

Can I file abroad first if my investors are overseas?

If the inventors are Indian residents, you must file in India first or get a foreign filing licence under Section 39. Breaking this rule can lead to the Indian application being treated as abandoned and to penalties.

Is a patent search enough before I launch my EV?

No. A patentability search checks whether your invention is new. A freedom-to-operate search checks whether your product infringes others' patents. Do both before launch.
