Software and apps
Yes, if it does more than run code. Indian law refuses software 'per se', but grants patents for software that solves a technical problem in a technical way.
AI and machine learning
AI inventions are patentable in India when the model is applied to solve a technical problem. A model or algorithm on its own is not.
Pharma and formulations
India grants product and process patents for medicines, but Section 3(d) sets a higher bar for new forms of known drugs than most countries.
Medical devices and diagnostics
Medical devices, implants and diagnostic kits are patentable in India. The procedure of treating or diagnosing a patient is not, so how you claim matters.
Mechanical and product inventions
Machines, tools, parts, consumer products and gadgets are the most straightforward inventions to patent, as long as they are more than a rearrangement of known parts.
EV, battery and clean-tech
Battery packs, cell chemistry, charging systems, motors and solar components are all patentable. Know how the chemistry and software rules apply before you file.
Agritech and food processing
Farm machinery, agri-sensors, fertilisers and food-processing methods can be patented. Ways of farming, plants and seeds cannot, but they have other protection.
