Medical devices, instruments, implants, diagnostic kits and the software that controls a device can be patented in India if they are new, inventive and industrially applicable. Section 3(i) excludes methods of medical, surgical, diagnostic or therapeutic treatment, so claim the device, kit or system rather than the procedure carried out on the patient. A patent does not replace regulatory approval under the Medical Devices Rules, 2017.
- Registered patent agentsPatent work is handled only by agents registered with the Indian Patent Office
- NDA before you shareWe sign a non-disclosure agreement before you send any technical details
- Your idea stays yoursNothing is filed or published without your written approval

Usually patentable
- Medical and surgical instruments, implants, prosthetics and wearables
- Diagnostic devices and kits, including in-vitro test kits and reagents
- Software that controls a device or processes physiological signals with a technical effect
- Manufacturing processes for devices
Usually not patentable
- A method of surgery or treatment performed on a patient (Section 3(i))
- A method of diagnosing a disease in a patient (Section 3(i))
- Simply combining known devices that each work independently (Section 3(f))
- Health apps that only record or display information (Sections 3(k) and 3(n))
Device yes, procedure no
Section 3(i) excludes "any process for the medicinal, surgical, curative, prophylactic, diagnostic, therapeutic or other treatment of human beings" (and animals). The policy is that doctors must be free to treat patients. The device, kit or system that makes the treatment possible remains patentable.
| Excluded claim | Patentable alternative |
|---|---|
| A method of inserting a stent using a new technique | A stent delivery catheter with the new release mechanism |
| A method of diagnosing anaemia from a blood sample | A diagnostic kit or device for measuring haemoglobin with the new sensing element |
| A method of monitoring a patient's heart rhythm | A wearable ECG device with the new signal-processing circuit |
| A method of physiotherapy | A rehabilitation device with the new actuator and control system |
Whether a test carried out on a sample outside the body counts as an excluded 'diagnostic' method has been argued in the courts, so claim the kit, device or reagent wherever you can.
Software in medical devices
Software that controls a device or processes physiological signals to give a technical result (better signal quality, faster detection, lower power use in a wearable) can be patented, following the technical-effect approach under Section 3(k). An app that only stores and shows health records generally cannot. See our guide to software patents.
Patent, design or both?
A patent protects how a device works. A design registration protects how it looks: its shape, configuration and surface pattern, for up to 15 years. For devices sold on appearance (handheld monitors, wearables), file both.
Patent and regulatory approval are separate
A patent gives you the right to stop others; it doesn't let you sell. Medical devices also need licensing under the Medical Devices Rules, 2017 through the drug regulator (CDSCO or the State authority, depending on the risk class). Plan both timelines together, and file for the patent before clinical evaluations or investor demos make the device public.
Before clinical trials and pitch decks
Trial registrations, conference posters and published papers can destroy novelty. File a provisional application first; you then have 12 months to file the complete specification.
Frequently asked questions
Can I patent a new surgical technique in India?
No. Methods of surgery and treatment are excluded under Section 3(i). You can patent a new instrument or device used in the technique.
Can a diagnostic kit be patented in India?
Yes, a new and inventive diagnostic kit, device or reagent can be patented. A method of diagnosing a disease in a patient cannot.
Do I need a patent to get CDSCO approval?
No. Patents and regulatory licences are separate. You need regulatory approval to sell a medical device whether or not it is patented.
Should a hospital or doctor file for a device they designed?
Yes, if it is new and inventive. Check employment or institutional IP policies first, since a hospital or university may own inventions made in the course of work.
