What is Foreign Patent Filing?

If you only need protection in one or two countries, filing directly there under the Paris Convention can be faster and cheaper than a PCT application. You must file within 12 months of your Indian application to claim its priority date.

We prepare the application to suit each office (for example, US claim format and an Information Disclosure Statement, or European claim structure), coordinate filing through experienced local patent attorneys, and manage prosecution through to grant, all from India and billed in rupees.

We also handle the PCT national phase in other countries if you filed a PCT application, and advise on whether a US provisional application makes sense for your startup.

Frequently asked questions about Foreign Patent Filing

Is an Indian patent valid in the USA or Europe?

No. A patent is valid only in the country or region that grants it. To protect your invention abroad, you need to file there, directly or through the PCT route.

PCT or direct filing: which is better?

Direct filing is usually cheaper for one or two countries and can lead to an earlier grant. PCT is better when you are unsure of your markets or need more time and funds, because it postpones country costs to 30 or 31 months.

How much does a US patent cost?

It depends on the size of your specification, the number of claims and how examination goes. US small-entity and micro-entity fee reductions may apply to startups and individuals. We give you a written estimate before filing.

I'm an Indian resident. Can I file in the US first?

Only with written permission from the Indian Patent Office on Form 25, or six weeks after filing in India, under Section 39 of the Patents Act. Filing abroad without it can lead to your Indian application being treated as abandoned and to penalties.
